Beasley Allen Reaches $1M Settlement for Auto Crash Survivor

Beasley Allen’s Montgomery personal injury lawyers reached a $1 million policy limits settlement with Amtech LLC of Lowndes County, Alabama, for client Seng Bouasisavat, who was seriously injured when involved in a car crash in a company vehicle in which she was carpooling.

On Jan 18, 2010, Seng and two others were riding as paying passengers in a vehicle owned and operated by Amtech. The company vehicle, driven by Amtech employee Nikki Smith, was traveling from a central location to the Amtech premises along Highway 22 in Coosa County when it left the roadway and hit a breakaway sign and an embankment. The vehicle came to rest partially in the eastbound lanes of the highway.

The crash left Seng with back injuries that required her to undergo emergency surgery and other medical treatment. Seng also incurred medical expenses for her injuries and lost wages due to her inability to work. Additionally, the lawsuit alleged that Seng suffered from physical pain and mental anguish and faced future medical expenses and lost wages.

Seng’s lawyers said the driver failed in her duty to operate the Amtech vehicle in a “reasonably safe manner.” She was also named as a defendant in the lawsuit.

“Defendant Smith breached her duty when she operated her vehicle in such a manner as to show a conscious disregard for the safety of others on the roadway [by] not paying attention to the … road ahead of her and failing to keep a proper lookout on the road,” the automobile crash lawsuit alleged.

As the owner and operator of the vehicle and Smith’s employer, Amtech was also liable for the crash, the lawsuit asserted.

Seng’s complaint requested a jury trial and sought compensatory and punitive damages plus interest and costs.
