Accident Overview
On September 27, 2023, our client was driving his Toyota Tacoma and trying to turn left at the intersection of Rackley Road and Highway 52. As he went through the intersection, a Ford Super Duty truck, speeding 15 miles over the limit, hit the back driver’s side of his vehicle.
The force of the impact propelled our client’s vehicle into a parked car at a nearby gas station, while the commercial truck continued moving for several yards before coming to a stop.
As a result of the accident, our client suffered multiple serious injuries, including fractures to his ribs, scapula, and spine. Despite these injuries, our client received several citations from the responding officer, who claimed that our client was responsible for the accident.

At the time of the collision, the commercial truck driver was performing duties within the scope of his employment. Because of this, the lawsuit claimed that the companies did not properly screen or supervise the driver. During the legal proceedings, evidence was shown to support two main points: 1) the driver should have been aware of the approaching intersection because of different traffic signs, and 2) the crash could likely have been avoided if the driver had stayed within the speed limit.
