Beasley Allen attorneys filed a class action lawsuit in federal court in Tennessee against Nissan North America, Inc. due to a design defect causing certain 2017-2019 Nissan and Infiniti vehicles to automatically brake with no obstacles in sight – often referred to as phantom braking – greatly increasing the risk of accident.

The class action lawsuit alleges that Nissan wrongfully and intentionally concealed defects in the subject vehicles’ front radar and camera system, which together form the companies’ Automatic Emergency Braking (AEB) systems. The plaintiffs claim the defective system detects non-existent obstacles, automatically applying the brakes, causing the subject vehicles to abruptly slow down or come to a complete stop.

The class action lawsuit follows a National Highway Traffic Safety Administration (NHTSA) investigation that logged complaints of nearly 900 Nissan/Infiniti drivers who experienced phantom braking. One driver wrote, “While the vehicle was in motion on both city streets and interstate highways, the automatic emergency brake (AEB) has activated when there wasn’t any traffic or obstacles present.” The driver further wrote, “At one time on the highway it almost caused an accident due to sudden and abrupt unneeded braking slowing the car unexpectedly [and] nearly causing cars behind me to run into me. This vehicle behavior has occurred multiple times.”
