Beasley Allen Report host Gibson Vance welcomes fellow Beasley Allen attorney Mike Andrews as his guest on this week’s show. Mike works in the firm’s Products Liability section. This section handles cases involving defective products. When individuals are harmed, injured or killed by an unsafe, or defective, product, they may have a cause of action against the manufacturer, supplier, distributor or retailer of that product. A products liability claim is usually based on design defect, manufacturing defect or a failure to warn about a defect. Many times, when Beasley Allen investigators look into a personal injury claim, they find a defective product is to blame. These cases are often uncovered in single-vehicle accidents and also in workplace injuries, related to defective or unsafe equipment. Mike discusses a case that involved a horse trailer. Due to a manufacturing defect in an awning attached to the trailer, an awning came loose during travel on a roadway, swung out into oncoming traffic and an innocent motorist could not avoid striking it. The awning went through the driver’s windshield and struck him in the head, and he was killed. While investigating the crash, Mike discovered that despite the trailer owner securing the awning properly, the awning locking system was not strong enough to secure the awning and broke, allowing the awning to swing free.
