According to WSFA, following the deaths of two men, 53-year-old Lomax Phillips of Birmingham and 63-year-old David Lee White of Montgomery, the U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) has issued R.R. Dawson Bridge Co. LLC four safety violations.
The families of the deceased victims are currently suing the R.R. Dawson Bridge Co. for failing to provide its employees with required fall protection. However, Beasley Allen attorney Greg Allen, who is currently representing the family of David Lee White in their wrongful death lawsuit, believes there is faulty equipment involved.
“We don’t really see this as much as an OSHA violation as a products case and that’s what we’re primarily focused on,” Allen said. “The problem was that they were wearing the fall protection they had and were tied off to the basket on the machine and unfortunately, the whole basket fell.”
