December, 2001 – Nursing home neglect case where our client, an elderly Mobile woman, had recently been diagnosed with terminal cancer. She was admitted to a Mobile nursing home for a short rehabilitation stay. She was in the home for approximately 6 days during which time she fell out of bed numerous times. Our client's son was not notified of all of the falls and the severity of the situation. Proper precautions were not taken to prevent her from falling out of bed. On the sixth day our client fell out of bed, hit her head on the floor and died. Testimony at trial included evidence that the facility did not have sufficient staff to provide the care the residents needed, that fraudulent charting existed in our clients medical records and that available precautions were not taken to prevent our client from falling.
