A class was filed on behalf of all customers that had purchased Miracle Ear brand hearing aids. The plaintiffs claimed that the hearing aids did not perform as represented, particularly that they did not block out "background noise" as represented in advertising. The case settled on a nationwide basis, with the court finding the settlement value to be in excess of $50 million.
