What are the dangers associated with highway construction areas?

There are a number of factors that may constitute a claim for personal injury or wrongful death involving highway construction areas. The construction company is responsible for ensuring a safe passage for motorists in and around the construction site. This includes clearly marking the construction zone and posting appropriate warning and navigational signage.

Additionally, the company must ensure the roadway is free of debris that may impair driving. This includes ensuring the roadway is properly irrigated to avoid situations where a vehicle may hydroplane, causing the driver to lose control.

For example, in a wrongful death case involving an automobile accident in a highway construction zone handled by Beasley Allen, the Plaintiff's decedent was a teenage passenger in the back seat of an automobile that entered into a construction zone. The construction company had constructed a detour lane for traffic to travel around ongoing construction. As a result of improper maintenance, design and/or construction, run off rainwater collected in the Plaintiff's lane of travel. The Defendants failed to provide for adequate drainage so as to protect the traveling public, and the Plaintiff's vehicle hydroplaned and the decedent was killed as a result of the injuries received in the accident.
