Defective Safety Equipment
What is involved in a claim with safety equipment?
The presence of safety equipment does not guarantee one’s safety, but it should enhance safety. It is the safety equipment manufacturer's and distributor’s duty to ensure that all of its safety equipment is in proper working condition. Safety equipment can range from seatbelts and child seats in your car to medical equipment and smoke detectors in your home.
Defective safety equipment may be due to the manufacturer’s need to rush a product’s development, resulting in ineffective design or shoddy construction. Some other contributing factors to a defective safety product may be as follows:
• Design flaws
• Incorrect or incomplete testing procedures to ensure safety
• Failure to distribute appropriate safety instructions
Product liability is the area of law in which manufacturers, distributors, suppliers, retailers, and others who make products available to the public are held responsible for the injuries those products cause. Most of these injuries could be avoided if the distributor or manufacturer of these products took additional steps to ensure the safety of their consumers.
