Beasley, Allen, Crow, Methvin, Portis & Miles, P.C. has filed a class action lawsuit (10-cv-243) on behalf of Alabama restaurant owners and food service businesses along the Alabama Gulf Coast for losses resulting from the massive oil spill in the Gulf of Mexico. Many of these businesses receive substantial income from tourists, vacationers and commercial and sports fishermen. The suit is filed in federal court in the Southern District of Alabama on behalf of plaintiff Tacky Jack's Restaurant, and seeks to represent those individuals and businesses that have incurred damages related to the disaster. The suit alleges negligence and wanton misconduct. Defendants named in the suit are BP, Halliburton, and Cameron International.

MONTGOMERY, ALA. (May 5, 2010)  - Beasley, Allen, Crow, Methvin, Portis & Miles, P.C. has filed a second class action lawsuit (2:10-cv-01344) on behalf of Louisiana fishermen affected by the BP oil spill. The suit filed in the Eastern District of Louisiana is filed on behalf of plaintiff Gulf Crown Seafood Inc., based in Delcambre, Louisiana, and seeks to represent individuals and businesses that have incurred damages related to the disaster, including real property damages; personal property damages; loss of profits and earning capacity; loss of commercial and subsistence use of natural resources; increased costs of public services; and loss of revenues.

Beasley Allen has filed a class action lawsuit against British Petroleum ("BP") and several other companies with ties to the Deepwater Horizon oil spill. The firm seeks to represent individuals and businesses that have incurred damages related to the disaster, including; real property damages; personal property damages; loss of profits and earning capacity; loss of commercial and subsistence use of natural resources; increased costs of public services; and, loss of revenues.




Consumer Fraud

W. Daniel "Dee" Miles, III has been selected for inclusion in the 2010 edition of The Heritage Registry of Who's Who. Miles is a shareholder with Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., law firm in Montgomery, and head of the firm's Consumer Fraud Section. Miles was selected in recognition of his accomplishments and achievements attained in the field of Legal Services.




Community

Beasley Allen Law Firm has selected the James M. Barrie Center in Etowah County, Ala., as the recipient of the fourth gaming system it will give away in its year long "Wii Give Back!" campaign. The Barrie Center is a member of the Alabama Network of Child Advocacy Centers. The Wii is becoming a popular therapeutic tool, useful in both physical therapy / rehabilitation and in working with young people facing crisis situations by providing caregivers with a tool to comfort and engage children.




Product Liability

After hearing from dozens of plaintiffs' attorneys last week, on April 9, 2010, the U.S. Judicial Panel on Multi-District Litigation announced it has selected the U.S. District Court for the Central District of California to hear litigation surrounding Toyota sudden unintended acceleration (SUA). Lawsuits include both individual personal injury claims and consumer class actions filed on behalf of Toyota owners who claim the value of their vehicles has been negatively affected by Toyota's SUA problems.

Montgomery Mayor Todd Strange presented a proclamation today to Wendi Lewis of www.myMeso.org declaring April 1-7 as Asbestos Awareness Week in the city of Montgomery, Alabama. The proclamation supports National Asbestos Awareness Week, as established by Senate Resolution 427.

MONTGOMERY, ALA. (April 6, 2010)  - Yesterday the National Highway Traffic Safety Administration (NHTSA) finally decided to get tough with automaker Toyota for safety problems involving almost all of the carmaker's models. The problem is Sudden Unintended Acceleration (SUA), in which vehicles race out of control despite drivers' attempts to stop them. NHTSA levied a record-setting $16.4 million fine against Toyota regarding its sticky accelerator pedal recall, saying the company did not notify the NHTSA in a timely way about the problem. Toyota has two weeks to accept or contest the penalty.




Product Liability

MONTGOMERY, ALA. (March 12, 2010)  - A Montgomery County jury awarded the estate of Catherine Parker $2.75 million against Ford Motor Company today. Parker was killed in July 2007 when her 1999 Ford Explorer rolled over during a crash. Beasley Allen attorneys Benjamin E. Baker, J. Cole Portis and J. Greg Allen represented Parker's estate against defendant Ford Motor Company.
