Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., has filed a lawsuit in the Circuit Court of Jefferson County, Alabama, on behalf of a young man badly burned and permanently injured when his car burned after a crash. The lawsuit alleges the automobile manufacturer, Ford Motor Company, was aware the design of the 1993 Ford Crown Victoria driven by the victim, 26-year-old Kevin Deandreas Boykins, was dangerous, presenting a significant risk of post crash fires, particularly in rear impacts.




Product Liability

The law firm of Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., represented the family of Beverlyn Wingard in a wrongful death lawsuit filed in Circuit Court of Montgomery County, Alabama. Ms. Wingard was killed in January 2008 while working for Albany International in Montgomery, when she was crushed by machinery she was operating at the textile plant. Montgomery County Circuit Judge Charles Price found on behalf of the Plaintiffs and awarded $5,250,000 in damages.




Product Liability

Beasley, Allen, Crow, Methvin, Portis and Miles, P.C. has filed a wrongful death lawsuit on behalf of plaintiff Horace Walton, whose daughter, Jennifer Leanne Walton, was killed on October 3, 2010, when the 1987 Dodge 15-passenger van in which she was a passenger rolled over several times and crashed. The van became uncontrollable after the tread on a rear tire separated, causing the tire to fail. The complaint (57-CV-2010-900201.00), filed today in the Circuit Court for Russell County, Alabama, alleges products liability, failure to warn, negligence and wantonness for the unsafe conditions of the van and tire. Defendants include Chrysler Group, L.L.C., Chrysler Group Vans, L.L.C., and R&J Tire Co. Inc.

United States District Judge James V. Selna today appointed W. Daniel "Dee" Miles, III, head of the Consumer Fraud section for Beasley, Allen, Crow, Methvin, Portis and Miles, P.C., to the Liaison Committee for personal injury/wrongful death cases in litigation against Toyota. April 9, 2010, the U.S. Judicial Panel on Multi-District Litigation selected the U.S. District Court for the Central District of California to hear litigation surrounding Toyota sudden unintended acceleration (SUA). Lawsuits include both individual personal injury claims and consumer class actions filed on behalf of Toyota owners who claim the value of their vehicles has been negatively affected by Toyota's SUA problems.

After hearing from dozens of plaintiffs' attorneys last week, on April 9, 2010, the U.S. Judicial Panel on Multi-District Litigation announced it has selected the U.S. District Court for the Central District of California to hear litigation surrounding Toyota sudden unintended acceleration (SUA). Lawsuits include both individual personal injury claims and consumer class actions filed on behalf of Toyota owners who claim the value of their vehicles has been negatively affected by Toyota's SUA problems.

MONTGOMERY, ALA. (April 6, 2010)  - Yesterday the National Highway Traffic Safety Administration (NHTSA) finally decided to get tough with automaker Toyota for safety problems involving almost all of the carmaker's models. The problem is Sudden Unintended Acceleration (SUA), in which vehicles race out of control despite drivers' attempts to stop them. NHTSA levied a record-setting $16.4 million fine against Toyota regarding its sticky accelerator pedal recall, saying the company did not notify the NHTSA in a timely way about the problem. Toyota has two weeks to accept or contest the penalty.

MONTGOMERY, ALA. (March 12, 2010)  - A Montgomery County jury awarded the estate of Catherine Parker $2.75 million against Ford Motor Company today. Parker was killed in July 2007 when her 1999 Ford Explorer rolled over during a crash. Beasley Allen attorneys Benjamin E. Baker, J. Cole Portis and J. Greg Allen represented Parker's estate against defendant Ford Motor Company.

Esdale and clients, Margie Louise Meibergen, Sharon L. Brandt and Julie Brandt Mayfield, will be attending the congressional hearings this week and are willing to speak to the media. The group appeared on the CBS Early Show Tuesday morning and later on CNN.

(February 11, 2010) - Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., has filed a complaint on behalf of more than 500,000 Toyota Prius and Lexus Hybrid owners whose vehicles have been recalled by Toyota Motor Sales, USA Inc. The complaint was filed in the United States District Court Middle District of Alabama against Toyota Motor Corporation and Toyota Motor Sales, USA, Inc.
