Trial Court awards $38.2 million to the State of Mississippi in Beasley Allen Medicaid fraud lawsuit

MONTGOMERY, ALA. (September 2, 2011) – Today Judge Thomas L. Zebert found in favor of the State of Mississippi in its case against pharmaceutical company Sandoz, Inc. in the Chancery Court of Rankin County, Mississippi, and awarded a total verdict of $38,191, 427.00. The case, Mississippi Medicaid Pharmaceutical Average Wholesale Price Litigation (Master Docket No. 65586-65632, 66312, 66313, 66314) involves allegations that Sandoz caused to be published inflated “Average Wholesale Prices” (AWPs) for the drugs manufactured by Sandoz, which resulted in the Mississippi Division of Medicaid (DOM) reimbursing pharmacies at an inflated price, all allegedly in violation of the Mississippi Consumer Protection Act; the Mississippi Medicaid Fraud Control act and common law fraud. Mississippi Attorney General Jim Hood authorized the filing of these lawsuits against the pharmaceutical companies and Beasley Allen attorneys W. Daniel “Dee” Miles, III and Clay Barnett, along with former Mississippi Governor Ronnie Musgrove from Copeland, Cook, Taylor and Bush tried the three-week trial in April.

Beasley Allen attorneys named to 2011 Super Lawyers list

MONTGOMERY, ALA. (April 29, 2011)  - Eleven Beasley Allen attorneys were selected for inclusion on the 2011 Super Lawyers list, a designation earned by fewer than five percent of lawyers in the state. Included on the list are the firm's founding shareholder, Jere L. Beasley, as well as shareholders J. Greg Allen, Thomas J. Methvin, J. Cole Ports, Daniel W. "Dee" Miles III, Andy D. Birchfield, Jr., Rhon E. Jones and Benjamin E. Attorneys say government findings on Toyota sudden unintended acceleration won't hold up under further scrutiny

On Feb. 8, the U.S. Department of Transportation released results of a 10-month study on the suspected cause of Sudden Unintended Acceleration that affected thousands of Toyota vehicles and prompted the recall of more than 8 million various makes and models beginning in late 2009. But lawyers and safety groups investigating claims of accidents, injuries and deaths caused by SUA say the study is incomplete and in no way exonerates Toyota or involvement of its electronic throttle system. The NASA study will not stand up when more exhaustive research is finalized, according to a number of safety groups.

Target shorts customers on coupons, Beasley Allen lawsuit says

A Jefferson County woman has filed a federal lawsuit against Target Corporation, claiming two area stores did not give her full credit for manfacturers' coupons she presented for purchases of baby wipes, frozen meals and baby food in September.

Toyota announces a new recall for brake problems

Toyota has announced another recall, this time involving more than 1.5 million vehicles worldwide, for problems with brake fluid and fuel pumps. The recall will affect 740,000 cars in the United States. Models affected by the recall in the U.S. include the 2005 and 2006 Avalon, 2004 through 2006 non-hybrid Highlander and Lexus RX330, and 2006 Lexus GS300, IS250 and IS350 vehicles.

Drugmakers must pay Hawaii $82 million in Medicaid Fraud settlement

The State of Hawaii has reached a settlement agreement with pharmaceutical companies accused of defrauding the state's Medicaid system by overcharging for medications. The State will receive more than $82 million from a number of different drug companies involved in the litigation, which accused the companies of marketing and selling prescription drugs using fraudulent and inflated "average wholesale price" figures.
