Montgomery, Ala. – Beasley, Allen, Crow, Methvin, Portis & Miles, P.C., has been retained by the families of two of the seven victims killed in a fiery van crash on U.S. 82 Oct. 3. The incident involved an Alabama Department of Corrections vehicle that was struck by an 18-wheeler early that Friday morning. The ADOC van was carrying employees and job applicants from a state prison near Union Springs to another prison when the crash occurred about 5:50 a.m.
Beasley Allen lawyers Jere L. Beasley, J. Greg Allen, J. Cole Portis and Kendall C. Dunson are representing the families of Rodney Kelley, a correctional officer with the Alabama Department of Corrections, 35, who was driving the ADOC van; and Derrick Ivey, Sr., 22, who was a passenger in the ADOC van en route to the prison for job training. Plaintiffs are Kelley’s wife, Carolyn Kelley, and daughter Makayla Kelley; and Ivey’s father, Bishop A. Ivey, and children, daughter Shalonda Ivey and son Derrick Ivey, Jr.
Defendants named in both cases are Lewis Trucking Company and its truck driver Andrew Carter, Jr; and Swift Transportation Co., Inc., and its driver Johnny Nunez. The Ivey case also names Leeposey Daniels, warden of Draper Correctional Facility in Elmore County, Ala., as a defendant. The Kelley case includes the Alabama Department of Corrections as a defendant. Other defendants will be added in the future. The complaints include counts of negligence and wantonness. The cases are filed in the Circuit Court of Montgomery County, Alabama.
