Nursing homes and assisted living facilities work to protect their businesses from legal action. One frequent protective measure they force upon patients and their loved ones is a mandatory pre-dispute binding arbitration agreement, which is included in the contract that is signed when a patient is admitted into the facility. Although the courts have allowed arbitration agreements to continue, they have also provided rights to nursing facility patients and their families.
