Pharmaceutical litigationFor decades pharmaceutical companies have received profits in their industry that now make it the most profitable in the world. Seizing the opportunity created by the public outcry for the concern over the HIV/AIDS epidemic, big pharmaceutical companies lobbied for and crafted legislation to allow for the fast tracking of drugs. The Prescription Drug User Fee Act (PDUFA), with its fast tracking drug approval provisions has accounted for an increasing introduction of new drugs into the marketplace over the last twelve years. A natural result of shortening the time period in which to investigate is the dizzying number of drugs recalled from the market, and those for which the Food and Drug Administration must require more stringent warnings than the companies are willing to provide on their own. Additionally, the number of consumers injured by pharmaceutical products has risen since the change to fast tracking drugs.

The attorneys in our Mass Torts Department take great pride in representing individuals harmed by the pharmaceutical and medical device industry, and in being among a small group of trial lawyers that are willing to fight these big companies. Currently we are litigating cases involving Hormone Replacement Therapy, Guidant & Medtronic Heart Devices , Bextra, Celebrex, Vioxx. Additionally, the Mass Torts attorneys continue to keep a vigilant eye on the actions of the pharmaceutical industry, and its interaction with the Food and Drug Administration. It seems that daily a big pharmaceutical company is being chastised by the FDA for failure to investigate or warn about drug problems, or worse yet, having its product pulled from the market. Until satisfactory regulation of this industry is once again imposed, the only corrective deterrent for this industry's behavior will come at the hands of the individuals and trial lawyers who are willing to stand up to big pharmaceutical companies and hold them accountable.

To that end, we have combined a national reputation as a leader in the area of Product Liability Litigation with our time-tested ability to handle large numbers of victims of consumer fraud to develop one of the largest and most technologically advanced Mass Torts practices in the country. The Mass Torts division represents numerous people in claims against companies that manufacture and/or market defective pharmaceuticals and/or medical devices. The substantial number of attorneys, staff and resources devoted to this division allows the firm to competently and conscientiously handle any group of cases, no matter how large, along with particular catastrophic injury cases.

In 2001, we reached a settlement on behalf of over 2,000 clients who were injured as a result of a defective drug.

In 2002, we were involved in the largest pharmaceutical settlement of its kind, to date. Thereafter, we were involved in two similar group settlements, eventually resolving all our client's claims. Also we were involved in settling several cases on behalf of clients who received defective orthopedic implants.

In 2002 we resolved a device claim for an amount in excess of $2,200,000 settlement

In 2003, we finalized a settlement on behalf of 2,500 clients who took a certain drug that was removed from the market amid safety concerns.

In 2004 we resolved an individual's serious personal injury claim for an amount in excess of $5,500,000 that helped her get necessary medical treatment.

By the end of 2004 we had settled over $80 million in claims on behalf of a number of Baycol users who suffered from rhabdomyolysis.

In 2005, we finalized a settlement on behalf of nearly 200 clients who took a certain drug that the FDA was reviewing as a result of a consumer watch group's petition to ban the drug.

In 2006, we successfully resolved several death claims related to a drug whose warning label had been modified continuously as a result of dangerous side effects.

In late 2006, we resolved an individuals personal injury claim for an amount In excess of $2,950,000 which will help her live independently and off government benefit programs.

In 2007 we entered into an agreement to resolve a few hundred claims for an amount estimated at $12,000,000 when settlement was consummated.

By October 2007 we had settled claims for approximately 60 clients in excess of $9,200,000 settlement involving pharmaceutical withdrawn from the market several years earlier.

In 2007 we resolved death claims in excess of $7,000,000 involving pharmaceutical whose label had been modified several times to reflect it's risks.
In November 2007 the largest pharmaceutical settlement ever was announced. Our lawyers were at the forefront of the negotiations that lead to Merck offering a $4.85 Billion settlement program to Vioxx victims.
In late 2007, we resolved several medical device claims in excess of $1,400,000.

Over the past couple of years, we have settled numerous cases involving defective orthopedic implants made by various companies.

We have resolved claims involving drugs that caused Stevens Johnson Syndrome (SJS). The SJS was so severe the client's lost their eyesight.

In addition to the Pharmaceutical and Medical device cases, we represent welders who have suffered neurological injury as a result of welding fumes.
