We have resolved claims for multiple property owners that were pending in the Kay County District Court of Oklahoma against Continental Carbon Company over air emissions of "carbon black" that have harmed the property of local residents, businesses and the local city government. The amount of the settlement is confidential, and we believe the resolution of these claims was in the best interest of all parties involved in the litigation. After the Eleventh Circuit Court of Appeals rejected the arguments of Continental Carbon Company to reduce the amount of the $20.7 million dollar verdict we obtained on behalf of an individual property owner, a local business and the City of Columbus, we are expecting Continental Carbon Company to ask the U.S. Supreme Court to hear their appeal. We believe the case was decided correctly by both U.S. District Judge Mark Fuller and the United States Court of Appeals for the Eleventh Circuit.
